Article 1 - Purpose of the site

The Emmanuel Pi Djob website (hereafter the “Website”) published by Epimuzik (hereafter the “Company”) is a showcase website that presents the company and its services to the internet user (hereafter the “Visitor”). This Website is accessible via the internet.

Article 2 - Personal data and cookies

The Company collects personal data within the framework of this Site. To find out more about the Company’s practices regarding the collection, use and communication of personal data, as well as the provisions relating to the exercise of rights, Visitors are invited to consult the “Privacy policy” of this Site.

Article 3 - Intellectual property

3.1 The Site

The Site and any software necessarily used in connection with it may contain confidential information and data protected by intellectual property law. Thus, unless otherwise stated, intellectual property rights to documents and data of any kind contained on the Site and each of the elements making up the Site (images, illustrations, sounds, texts, graphic elements, charter, etc.), including software, databases and newsletters, are the exclusive property of L’Entrepise (hereafter the “Content”), which grants no license or right other than that of consulting the Site. 3.2 Trademarks

The Company is the owner of the Alkïos Formation brand and its logos (hereafter the “Brand”).

The visitor acknowledges the Company’s exclusive rights to the Brand and undertakes not to use it in any way whatsoever or, more generally, to infringe the Company’s intellectual property rights. The Company reserves the right to claim damages in the event of counterfeiting and, more generally, infringement of its intellectual property rights. Similarly, the Visitor undertakes not to infringe the property rights, and in particular the intellectual property rights, of any company in the group to which The Company belongs.

All other trademarks or logos appearing on the Site are the property either of L’Entrprise, or of a company in the group to which it belongs, or of its service providers, partners or suppliers. Any use whatsoever of these trademarks and/or logos and/or any other Content is subject to the express authorization of L’Entreprise or the holder of the intellectual property rights concerned.

3.3. Hypertext links

The Site may include links to other websites or other Internet sources. Insofar as the Company cannot control these external sites and sources, it cannot be held responsible for the availability of these external sites and sources, and cannot be held responsible for the content, advertising, products, services or any other information or data available on or from these external sites or sources. Furthermore, the Company shall not be held liable for any damage or loss, whether actual or alleged, arising out of or in connection with the use of or reliance on the content, goods or services available on such external sites or sources.

Any creation of links to the Company’s Site, any framing of the Site, and more generally any use of a component of the Site, is subject to its prior and express authorization, which may be revoked at any time at its sole discretion. The Company reserves the right to (i) request the deletion of any link to the Site that has not been, or is no longer, authorized, and (ii) claim damages for any loss suffered as a result.

Article 4 - Visitor behavior

Each Visitor must use this site with respect and courtesy towards the rights of other Internet users.

In this respect, the Visitor, when accessing the Site, is prohibited from:

  • Upload to the Site, post, send by e-mail or transmit by any other means any content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, contrary to morality, invasive of a person’s privacy, including their right to image, odious or derogatory or shocking from a racial, ethnic or other point of view;
  • upload to the Site, post, send by e-mail or transmit by any other means unsolicited or unauthorized advertising or promotional materials, “advertising prints”, “misleading information”, “chain letters”, or any other form of solicitation;
  • upload to the Site, post, send by e-mail or transmit by any other means any material that contains software viruses or other computer codes, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or any telecommunications equipment;
  • disrupt or interrupt the Site or the servers or networks connected to the Site, or violate the requirements, procedures, rules or regulations of the networks connected to the Site;
  • attempt to undermine the service of any user, host or network, including, but not limited to, exposing the Site to a virus, creating saturation, flooding the server, to saturate the e-mail system or to falsify any TCP/IP protocol information packet header or any part of the header information contained in any e-mail;
  • to access data not intended for the Visitor or to enter a server/account to which the Visitor is not authorized to have access;
  • attempt to probe, scan or test the vulnerability of a system or network, or to breach security or authentication measures without authorization;
  • impersonate another person;
  • carrying out an activity or encouraging a third party to carry out an illegal activity or any other activity that would infringe on the rights of the Company, its suppliers, partners, distributors, advertisers or any other Visitor;
  • transmit or transfer (by any means whatsoever) information or software derived from the Site, particularly to other countries or to certain foreign nationals, in violation of national or international laws or regulations.

Recognizing the global nature of the Internet, each Visitor agrees to abide by all local and international rules and procedures regarding online behavior and acceptable content, and in particular all applicable laws regarding the transmission of technical data.

At any time and for any reason whatsoever, the Company may implement any means allowing it to terminate, without notice, the Visitor’s use of the Site or any of the Company’s services for any conduct violating these terms of use, without prejudice to any damages and interest that the Company reserves the right to claim from the Visitor in the event of non-compliance with these general terms of use of the Site.

Article 5 - Liability

5.1. Site access and operation

The Visitor is personally responsible for setting up the computer and telecommunications resources required to access the Company’s Site and for acquiring the knowledge required to use the Internet and access the Site. The Visitor shall bear the connection and equipment costs associated with Internet access and use of the Company’s Site.

The Visitor uses the Site at his or her own risk. The Company may not be held liable for any damage that any Visitor may suffer as a result of such use. Furthermore, the Company DISCLAIMS ALL LIABILITY FOR INDIRECT DAMAGES, WHETHER THE CAUSE, ORIGIN, NATURE OR CONSEQUENCE, INCLUDING, IN PARTICULAR, COSTS WHICH MAY ARISE FROM THE PURCHASE OF GOODS OFFERED ON THE SITE, LOSS OF PROFITS, LOSS OF PROFITS, GOODWILL, DATA OR ANY OTHER LOSS OF INTANGIBLE PROPERTY THAT MAY ARISE AS A RESULT OF ANY PERSON’S ACCESS TO THE SITE OR INABILITY TO ACCESS THE SITE OR RELIANCE ON ANY INFORMATION OBTAINED DIRECTLY OR INDIRECTLY FROM THE SITE.

5.2. Limitation of liability

The Site also contains information from third parties, and links to other Internet sites. The Company has no control over the accuracy of the information contained therein, nor over its content. Accordingly, the Company shall not be liable for any damages resulting from the use of, access to, or inability to use such third-party information, or from the content of other websites.

Any complaint lodged by a Visitor against the Company must be made within 6 months of the occurrence of the event which is the subject of the complaint.

Article 6 - General

6.1. Amendments

The Company reserves the right to modify and update the General Terms and Conditions of Use without prior notice. In order to be informed of any such modifications, the Company advises the Visitor to reread the GCU on a regular basis. Use of the Site is subject to the GTCU in force at the time of use.

6.2. Entirety

In the event that one of the clauses of these GCU should become null and void as a result of a change in legislation, regulations or by a court decision, this shall in no way affect the validity of and compliance with the other clauses of the GCU.

6.3. Applicable law

These GCU are governed by French law.

ANY DISPUTE RELATING TO THE EXISTENCE, INTERPRETATION, PERFORMANCE OR BREACH OF CONTRACT BETWEEN SARL AS1955 AND THE VISITOR, EVEN IN THE EVENT OF MULTIPLE DEFENDANTS, SHALL, IN THE ABSENCE OF AMICABLE AGREEMENT, BE SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE COURTS OF NIMES. THIS ATTRIBUTION OF JURISDICTION IS VALID NOTWITHSTANDING PLURALITY OF DEFENDANTS OR THE INTRODUCTION OF THIRD PARTIES, EVEN FOR EMERGENCY PROCEDURES OR CONSERVATORY PROCEDURES IN CHAMBERS OR BY PETITION.
